Legal Battles and Internal Conflict at OpenAI

The world of artificial intelligence is currently facing a major legal challenge. OpenAI, the company behind the famous ChatGPT, is in the middle of a month-long trial against its former co-founder, Elon Musk. This court case in Oakland has exposed deep divisions within the company and raised questions about how powerful AI businesses should be managed.

Elon Musk, who helped start OpenAI in 2015, is suing the company’s current leaders, Sam Altman and Greg Brockman. Musk claims that they broke their original agreement by changing OpenAI from a non-profit organization—a group that works for the public good rather than for money—into a for-profit enterprise. According to The Guardian, Musk wants the court to remove Altman and Brockman from their positions and reverse the company’s business structure. He is also seeking $134 billion in damages, which he argues should be given back to the non-profit arm of the company.

OpenAI strongly denies these claims. The company’s lawyers argue that Musk was always aware of the plans to raise money from investors. They suggest that Musk is acting like a "sore loser" who is seeking revenge because he left the company in 2018 after failing to gain full control. During the trial, Greg Brockman described a tense 2017 meeting where Musk demanded more power. According to BBC Business, Brockman told the jury that Musk’s mood changed suddenly when his request was denied, and he even feared that Musk might hit him. Shortly after that meeting, Musk stopped providing funding to the company.

The trial has also brought attention to the role of Shivon Zilis, a senior executive at Musk’s company, Neuralink. Zilis served on the board of OpenAI from 2020 to 2023. The Guardian reports that OpenAI’s lawyers presented text messages suggesting that Zilis acted as an inside source for Musk after he left the company. In one 2018 message, Zilis asked Musk for advice on whether she should stay friendly with OpenAI to keep information flowing. Musk responded by telling her to stay close, while also mentioning plans to recruit OpenAI staff for his own projects. Zilis testified that she and Musk have a personal relationship and are the parents of four children.

Beyond the conflict with Musk, the trial has revealed internal problems regarding leadership. Mira Murati, the former Chief Technology Officer of OpenAI, testified that she found it difficult to trust Sam Altman. In a video deposition, Murati claimed that Altman lied to her about safety standards for a new AI model. She stated that Altman falsely told her that the company’s legal department had approved the release of the model without a full safety review. According to The Verge, Murati noted that she had to work in a very complex environment where she felt Altman was "pitting his execs against one another."

These accusations of dishonesty are not new. The Verge reports that other former leaders, including co-founder Ilya Sutskever and board member Helen Toner, have previously raised concerns about Altman’s communication style. When the board fired Altman in 2023, they stated that he was not "consistently candid"—meaning he was not always honest—in his communications. Although Altman was later rehired, these testimonies suggest that the company has struggled with internal trust for a long time.

The implications of this trial are significant for the entire technology industry. As AI becomes more powerful and valuable, the debate over whether these companies should prioritize profit or safety continues to grow. For now, the court must decide if OpenAI’s shift to a for-profit model was a fair business decision or a betrayal of its original mission.
