Supreme Court Keeps Abortion Pill Available by Mail

The United States Supreme Court recently made a major decision regarding access to mifepristone, a common medication used for abortion. In a 7-2 ruling, the court decided that the pill can continue to be sent through the mail to patients. This decision provides a temporary victory for those who support access to the drug, as it blocks a lower court’s order that would have stopped this practice nationwide.

The case started when the state of Louisiana sued the US Food and Drug Administration (FDA). The FDA is the government agency responsible for ensuring that food and medicine are safe. Louisiana argued that the FDA’s rules for prescribing mifepristone remotely were problematic. Specifically, the state claimed that allowing the drug to be mailed to people in Louisiana interfered with the state’s own local ban on abortion. A lower court, the Fifth Circuit Court of Appeals, had previously agreed with Louisiana, which would have effectively ended mail-order access to the drug across the entire country.

However, the Supreme Court found that Louisiana did not have the legal standing to challenge the FDA’s rules in this way. In legal terms, having "standing" means a person or group has a valid, direct reason to bring a lawsuit to court. Because the court decided the state lacked this standing, the case was sent back to the lower court. This means the current rules will stay in place while the legal process continues. Experts expect the case to return to the Supreme Court for an official appeal in the future.

This is not the first time the Supreme Court has dealt with this issue. In 2022, the court overturned Roe v. Wade, a landmark decision that had protected the right to abortion for decades. Since that time, many states have banned abortion entirely. Because medication abortions now account for nearly two-thirds of all abortions in the U.S., the availability of these pills is a central part of the national debate. According to The Guardian, abortion rates have remained steady in recent years, largely because patients can still receive these medications by mail.

There are strong disagreements regarding this topic. In their dissenting opinions—the written arguments of judges who disagree with the majority—Justices Clarence Thomas and Samuel Alito argued against the ruling. Justice Thomas suggested that mailing the pills could be considered a "criminal enterprise." He also pointed to the Comstock Act, an old law from 1873 that prohibited the mailing of materials related to abortion. Justice Alito expressed concern that the current rules are part of a plan to weaken the court’s 2022 decision that ended the federal right to abortion.

Meanwhile, the FDA maintains that mifepristone is safe and effective. The agency first approved the drug in 2000 and later removed the requirement for patients to visit a doctor in person to receive it. This change allowed for "telehealth" appointments, where a patient speaks with a doctor over a video call instead of visiting an office. According to STAT News, the FDA has repeatedly reviewed the safety of the medication and found it to be reliable.

The political environment surrounding this issue is also very tense. STAT News reports that anti-abortion groups have been putting pressure on the government to speed up a new safety review of the drug. These groups hope that a new review will lead to stricter rules, such as stopping the use of telehealth platforms for prescribing the pill. This pressure recently led to the resignation of the FDA Commissioner, Marty Makary, after months of criticism from political leaders.

For now, women across the country can still obtain mifepristone through pharmacies or by mail without needing an in-person visit. While the Supreme Court has preserved this access for the time being, the legal battle is far from over. As the case moves through the court system again, the future of medication abortion remains a major point of conflict in American law and politics.
