Meta Ordered to Pay $567 Million for Youth Mental Health Impact

A court in New Mexico has ordered Meta, the parent company of Facebook and Instagram, to pay $567 million to address the negative effects its platforms have had on the mental health of young people. This new ruling is part of a larger legal battle that began in 2023 when the New Mexico Attorney General, Raúl Torrez, sued the technology giant. The total amount Meta is now required to pay reaches $942 million, following an earlier $375 million fine decided by a jury in March.

According to The Guardian, the judge in the case, Bryan Biedscheid, stated that most of the $567 million will be used to provide treatment services for young people in New Mexico. The remaining funds will support awareness campaigns, prevention programs, and screening services over the next five years. Ars Technica reports that the judge described the situation as a “public nuisance,” noting that the state is currently facing a serious youth mental health crisis. This crisis includes higher rates of suicide and eating disorders, which have placed a heavy burden on public resources.

This legal action follows a 2023 investigation by The Guardian, which found that Facebook and Instagram had become places where child sex trafficking could occur. During the first phase of the trial, a jury found that Meta knowingly harmed children’s mental health and failed to protect them from exploitation. The second phase of the trial focused on "abatement," which is a legal term for actions taken to reduce or stop a harmful situation. The judge concluded that Meta contributed to this problem by creating features designed to keep users, especially teenagers, on their platforms for as long as possible.

Beyond the financial penalty, the court has ordered Meta to make significant changes to how its platforms operate in New Mexico. The company must now build "banner" screens—which are informational notices—to clearly explain its safety tools and how to report inappropriate comments. Furthermore, Meta is required to improve its "age-assurance" tools. Because federal privacy laws prevent the company from directly checking the ages of children under 13, the court ordered Meta to use artificial intelligence to estimate the ages of users based on their friends and the content they view. The company must also attempt to create a model that can predict if a user is under 13 within the next two years.

If Meta estimates that a user is under 13, the company must treat them as a child until they can prove their age. Additionally, the court ordered Meta to work with schools or child safety groups to create a system where school staff can report users who might be underage. Meta is also required to delete any personal information it has collected from users found to be under 13. The company must provide progress reports to the state twice a year to show that it is following these new rules.

New Mexico’s Attorney General, Raúl Torrez, praised the court’s decision. He stated that the case was always about protecting families and ensuring that large technology companies cannot profit from practices that put young people in danger without facing consequences. The judge noted that these changes are necessary because the current systems for addressing these harms have been overwhelmed.

This ruling is significant because it is the first time a court has found Meta responsible for actions taken on its platform in this way. While Meta has reported billions of dollars in revenue, the court emphasized that the company must now take responsibility for the "public nuisance" it helped create. As the company moves forward, it will be under close supervision by the state of New Mexico to ensure that these safety measures are actually put into practice.
